Terms of Service

Heir Lens is a real estate research and data platform designed to assist real estate professionals with property research, owner research, deceased-owner research, family-tree and potential-heir research, contact-data research, property-related lead analysis, and related real estate marketing and curative-title workflows.

Depending on the features used, Heir Lens may combine, analyze, organize, or present information obtained from public records, publicly available sources, licensed third-party data providers, user-provided information, automated research tools, and other sources.

Features may include, without limitation:

• Property and ownership information;
• Deceased or vitality indicators;
• Obituary and publicly available web research;
• Family relationships and family-tree research;
• Identification of potential heirs, relatives, or associates;
• Contact information such as addresses, telephone numbers, and email addresses;
• Potential heir occupancy indicators;
• Property and owner research;
• Automated inheritance-law analysis;
• Lead scoring and research prioritization;
• Skip tracing and data enrichment; and
• Reports, summaries, visualizations, and other research outputs.

Heir Lens is a research tool. The Service is intended to help users identify information that may warrant further investigation. It does not replace independent due diligence or professional legal, title, genealogical, probate, or other professional analysis.

You must be at least 18 years old and legally capable of entering into a binding agreement to use Heir Lens.

The Service is intended primarily for licensed real estate agents, brokers, real estate investors, and other real estate professionals using the Service for legitimate real estate business, marketing, research, property acquisition, title-curative, or related purposes permitted by Heir Lens.

You may use the Service only for lawful purposes and in accordance with these Terms.

If you use Heir Lens on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes both you individually and the organization you represent.

You are responsible for maintaining the confidentiality and security of your account credentials.

You are responsible for all activity conducted through your account, including activity by employees, contractors, team members, or other persons whom you permit to access your account.

You agree to:

• Provide accurate account information;
• Keep your account information reasonably current;
• Use reasonable measures to protect your login credentials;
• Not share your account with unauthorized persons;
• Promptly notify Heir Lens if you believe your account has been compromised; and
• Ensure that anyone using the Service through your account complies with these Terms.

Heir Lens may impose reasonable limits on account sharing, concurrent use, automated activity, API access, searches, reports, or other functionality in order to protect the Service and comply with contractual or technical requirements.

Subject to these Terms, Heir Lens grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Service for your own internal business purposes and permitted real estate activities.

Information obtained through Heir Lens may be used internally to assist with legitimate real estate research, marketing, prospecting, property acquisition, property-owner outreach, inherited-property research, curative-title research, and related real estate business activities.

Your right to use information obtained through Heir Lens does not give you ownership of the underlying databases, datasets, proprietary systems, licensed data, or other intellectual property from which such information may have been derived.

Certain information made available through Heir Lens is derived from proprietary or licensed third-party data sources. Your access to such information is therefore subject to important restrictions.

Except where expressly authorized by Heir Lens, you may not:

• Resell, sublicense, rent, publish, distribute, broadcast, or commercially redistribute data obtained through Heir Lens;
• Offer Heir Lens data as a standalone data product, database, data feed, directory, or competing information service;
• Make underlying data publicly available in a manner that permits copying, extraction, reuse, or reconstruction;
• Create, compile, populate, or enhance a database or dataset that substitutes for, replicates, or competes with Heir Lens or an underlying data provider;
• Systematically download, harvest, scrape, crawl, extract, copy, or collect information from Heir Lens;
• Use bots, scripts, automated agents, crawlers, scraping tools, or other automated means to access the Service except through functionality or APIs expressly authorized by Heir Lens;
• Circumvent search limits, usage limits, rate limits, account restrictions, technical protections, security measures, or access controls;
• Reverse engineer, decompile, disassemble, manipulate, or attempt to derive the underlying structure of the Service or any protected data;
• Remove, alter, defeat, or interfere with security measures, watermarks, attribution, access controls, or other technological protections;
• Permit a third party to access data obtained through your account except as expressly permitted under these Terms;
• Use Heir Lens to operate a data-brokerage, data-resale, directory-assistance, or similar standalone data business; or
• Use the Service in any manner designed to substitute for obtaining authorized access to the underlying data or Service.

Limited individual reports or results may be used within your organization for your permitted business purposes, subject to these Terms.

HEIR LENS IS NOT A CONSUMER REPORTING AGENCY, AND THE SERVICE AND INFORMATION PROVIDED THROUGH HEIR LENS ARE NOT INTENDED TO CONSTITUTE “CONSUMER REPORTS” UNDER THE FAIR CREDIT REPORTING ACT (“FCRA”).

You may not use Heir Lens, in whole or in part, as a factor in determining a person’s eligibility for:

• Credit or financing;
• Employment;
• Insurance;
• Tenant or housing screening;
• Consumer credit decisions; or
• Any other purpose governed by or requiring a permissible purpose under the FCRA or similar state consumer-reporting laws.

You may not represent to another person or organization that information obtained through Heir Lens is a consumer report or has been verified for a consumer-reporting purpose.

You may not use Heir Lens or information obtained through the Service:

• For any unlawful purpose;
• To commit or facilitate fraud, identity theft, deception, or other illegal activity;
• To harass, stalk, threaten, intimidate, or harm another person;
• To knowingly assist a person or organization engaged in fraudulent, deceptive, unethical, or illegal activity;
• To target a person under the age of 18;
• To violate privacy, data-protection, consumer-protection, telemarketing, advertising, or solicitation laws;
• To impersonate another person or misrepresent your identity or authority;
• To introduce viruses, malware, spyware, Trojan horses, worms, malicious code, or other harmful technology into the Service;
• To interfere with the security, availability, operation, or performance of the Service;
• To gain unauthorized access to another account, system, database, or network;
• To facilitate discriminatory or otherwise unlawful decisions about individuals;
• For unlawful surveillance or unauthorized investigations;
• In violation of applicable economic sanctions or other applicable federal restrictions; or
• In any manner that would cause Heir Lens to violate an agreement with one of its data, technology, or service providers.

Heir Lens may restrict additional activities when reasonably necessary to comply with law, protect individuals, protect the Service, or comply with contractual obligations applicable to Heir Lens.

You are solely responsible for how you use information obtained through Heir Lens to communicate with property owners, potential heirs, relatives, prospects, or other persons.

Your use of contact information does not mean that a particular communication is legally permitted.

You are responsible for determining and maintaining any consent, permissible purpose, registration, licensing, suppression, opt-out, or other requirements applicable to your communications.

This includes compliance, where applicable, with federal, state, and local laws governing telephone calls, text messages, emails, direct mail, advertising, solicitation, privacy, and marketing, including applicable Do Not Call requirements, the Telephone Consumer Protection Act (“TCPA”), CAN-SPAM Act, and similar state laws.

Heir Lens does not provide legal advice regarding your marketing practices or determine whether any particular outreach campaign complies with applicable law.

Heir Lens may use automated systems, algorithms, artificial intelligence, machine-learning tools, or similar technologies to assist in organizing, analyzing, comparing, summarizing, or presenting information.

Automated processing may be used, for example, to assist with:

• Matching individuals and records;
• Interpreting family relationships;
• Reviewing publicly available sources;
• Organizing family trees;
• Identifying potential heirs;
• Applying inheritance rules;
• Summarizing research;
• Identifying possible occupancy;
• Comparing names, dates, addresses, and relationships; and
• Generating research scores or classifications.

These systems may make mistakes.

You should not treat an automated result as independently verified merely because Heir Lens generated or displayed it.

You may not systematically use Heir Lens data or outputs to train, fine-tune, validate, develop, or improve an external artificial-intelligence or machine-learning model, or upload or provide substantial portions of Heir Lens data to another AI or machine-learning service for such purposes, without prior written permission from Heir Lens.

You may not use Heir Lens or information derived from the Service to make automated consequential decisions regarding an individual’s eligibility for credit, employment, insurance, housing, or other legally protected opportunities.

Family trees, relationships, heir lists, ownership shares, inheritance calculations, and similar outputs generated by Heir Lens are research estimates and leads for further investigation.

A person identified by Heir Lens as an “heir,” “potential heir,” “relative,” “family member,” “owner,” “occupant,” or similar designation has not necessarily been legally determined to hold that status.

Actual legal heirship can depend on facts and documents that may not be available to Heir Lens, including, without limitation:

• Wills;
• Trusts;
• Probate proceedings;
• Estate administrations;
• Court orders;
• Adoption;
• Paternity or parentage;
• Divorce;
• Marriage;
• Renunciation or disclaimer of inheritance;
• Deeds;
• Transfers occurring before or after death;
• Survivorship rights;
• Property characterization;
• Creditor claims;
• Life estates;
• Unknown or omitted descendants;
• State-specific inheritance rules; and
• Other legal or factual circumstances.

You are responsible for independently verifying heirship and ownership before relying upon the information in a transaction or legal proceeding.

Heir Lens is not a law firm, title company, probate court, genealogical certification service, or legal-services provider.

Nothing provided through Heir Lens constitutes:

• Legal advice;
• A legal opinion;
• A title opinion;
• A determination of marketable title;
• A judicial determination of heirship;
• Probate advice;
• Estate-planning advice;
• Tax advice;
• A certified genealogy;
• A determination that a person has legal authority to sell or transfer property; or
• A guarantee that all persons whose signatures or consent may be required for a transaction have been identified.

Inheritance-law information presented by the Service is intended to assist with research and should not be relied upon as a substitute for advice from a qualified attorney.

Where heirship, probate, title, ownership, or inheritance rights are material to a transaction, users should obtain appropriate legal or title review before acting.

Heir Lens attempts to provide useful research information, but we do not guarantee that information provided through the Service is accurate, complete, current, or error-free.

Information may originate from public records, government records, licensed databases, historical records, obituaries, publicly available websites, user submissions, automated systems, and other third-party sources.

Those sources may contain errors, omissions, delays, conflicting information, outdated information, incorrect associations, or incomplete records.

Among other things, Heir Lens does not guarantee the accuracy of:

• Owner names;
• Property ownership;
• Parcel information;
• Mailing addresses;
• Phone numbers;
• Email addresses;
• Ages;
• Deceased or living status;
• Dates of death;
• Family relationships;
• Marital relationships;
• Heir identities;
• Number of heirs;
• Ownership percentages;
• Occupancy;
• Probate status;
• Estate information;
• Property characteristics;
• Liens or judgments;
• Lead scores; or
• Other research results.

Data availability and accuracy may vary by jurisdiction, county, source, record type, and individual.

Public records and third-party datasets change over time, and updates may not occur immediately.

A “match,” “confirmed,” “likely,” “potential,” or similar designation within Heir Lens reflects the information and research methodology available to the Service and does not constitute a legal guarantee.

You are responsible for independently verifying information before relying upon it.

Heir Lens relies on third-party data providers, public-record sources, websites, technology providers, APIs, hosting providers, payment processors, artificial-intelligence processing services, and other third-party services.

Certain information available through Heir Lens may be owned or licensed by third parties.

Your use of the Service does not grant you any ownership interest in such third-party data.

Third-party sources may:

• Change the information they provide;
• Modify coverage;
• Impose usage restrictions;
• Experience outages;
• Discontinue services;
• Change APIs or technical requirements;
• Remove records;
• Correct or modify information; or
• Stop making certain information available.

As a result, Heir Lens may add, modify, limit, suspend, substitute, or discontinue features or data sources at any time.

Heir Lens is not responsible for the independent acts, omissions, availability, or accuracy of third-party data sources.

The Service may allow you to submit property addresses, owner names, contact information, lead lists, CSV files, spreadsheets, notes, or other information (“User Data”).

You represent and warrant that you have the lawful right to provide User Data to Heir Lens and to instruct Heir Lens to process it for the purposes requested.

You retain your rights in your User Data.

You grant Heir Lens a limited right to host, process, transmit, organize, analyze, reproduce, and otherwise use User Data as reasonably necessary to provide, secure, support, and improve the functionality of the Service and fulfill your requests, subject to our Privacy Policy and applicable contractual restrictions.

You may not upload information that you obtained unlawfully or information that you are legally or contractually prohibited from providing to Heir Lens.

Certain Heir Lens functions may consume paid credits, searches, “pulls,” or other usage units.

Before initiating a paid function, the Service may indicate the number of credits or units that will be charged.

A successful request may consume the applicable credit or usage amount even if:

• The resulting information is incomplete;
• No matching information is found;
• A third-party source contains limited data;
• The user already knows some or all of the returned information; or
• The research result differs from the user’s expectations.

Charges relate to the processing or data request performed, not to a guarantee that a particular result will be found.

Users are responsible for reviewing applicable charges before initiating a paid action.

Heir Lens may implement confirmation screens, usage limits, warnings, rate limits, account controls, or other safeguards intended to prevent accidental or abusive usage.

Attempting to bypass or defeat those safeguards is prohibited.

Prices, subscription fees, credit packages, usage rates, and available plans are displayed through the Service or applicable ordering process and may change from time to time.

You agree to pay all charges that you authorize through your account.

Unless otherwise stated at the time of purchase:

• Purchased and consumed searches, credits, or pulls are non-refundable once used;
• Fees already incurred are not refundable merely because the resulting information was incomplete or unsuccessful;
• You are responsible for applicable taxes; and
• Promotional credits have no cash value.

Any refund required by applicable law will be honored.

If Heir Lens offers recurring subscriptions, you authorize Heir Lens or its payment processor to charge the payment method associated with your account at the applicable recurring interval until the subscription is canceled in accordance with the cancellation terms displayed during purchase or account management.

We may change pricing prospectively. Pricing changes will not retroactively alter charges already incurred.

You may not intentionally trigger searches, reports, skip traces, data requests, or other paid functions for the purpose of:

• Creating unnecessary costs for Heir Lens;
• Testing or exhausting system limits;
• Harassing Heir Lens;
• Degrading system performance;
• Circumventing applicable pricing;
• Exploiting a software error;
• Causing excessive third-party API usage; or
• Interfering with other users’ access to the Service.

Heir Lens may rate-limit, suspend, restrict, or terminate an account that exhibits fraudulent, abusive, automated, or unreasonable usage patterns.

Except for User Data and third-party materials, Heir Lens and its licensors retain all right, title, and interest in and to the Service, including its software, interfaces, workflows, algorithms, designs, text, graphics, reports, scoring methodologies, research methodologies, databases, trademarks, branding, and other intellectual property.

No rights are granted to you except the limited rights expressly stated in these Terms.

“Heir Lens,” associated logos, and other Heir Lens names and branding may not be used without our prior written permission.

If you voluntarily provide suggestions, ideas, comments, bug reports, recommendations, or other feedback relating to Heir Lens, you permit us to use that feedback without restriction or compensation to you.

This does not transfer ownership of your User Data to Heir Lens.

Our collection, use, processing, retention, and disclosure of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

You agree to comply with applicable privacy and data-protection laws in connection with your use of information obtained through Heir Lens.

Where required to fulfill applicable privacy rights or contractual obligations, Heir Lens may correct, restrict, suppress, or delete information from the Service or from information associated with your account.

Heir Lens uses commercially reasonable administrative, technical, and organizational measures designed to protect the Service and information processed through it.

However, no system or method of electronic transmission or storage can be guaranteed to be completely secure.

You are responsible for appropriately securing information that you download, export, copy, or otherwise maintain outside of Heir Lens.

You agree to promptly notify Heir Lens if you become aware of unauthorized access to your account or misuse of information obtained through the Service.

Heir Lens may suspend, restrict, or terminate your access to some or all of the Service if we reasonably believe:

• You violated these Terms;
• Your use is unlawful;
• Your account presents a security or privacy risk;
• Your usage is fraudulent or abusive;
• You are attempting to scrape, extract, redistribute, or misuse data;
• Your activity may expose Heir Lens or a third-party provider to legal, regulatory, contractual, financial, or security risk;
• A data or service provider requires Heir Lens to restrict the relevant access;
• Continued access would threaten the operation or integrity of the Service; or
• Suspension is otherwise reasonably necessary to protect Heir Lens, its users, its licensors, data subjects, or third parties.

Where commercially reasonable and appropriate under the circumstances, Heir Lens may provide an opportunity to correct a curable violation before permanently terminating an account.

However, Heir Lens may act immediately where necessary to address suspected fraud, unlawful activity, security incidents, serious privacy violations, data-provider requirements, abuse, or substantial risk of harm.

Upon termination, your right to access and use the Service ends.

Certain data or licensed information may be deleted, disabled, or rendered inaccessible following termination where required by law, contract, or applicable data-provider requirements.

Sections of these Terms that by their nature should survive termination — including restrictions on data use, intellectual-property provisions, disclaimers, liability limitations, and indemnification obligations — will survive.

We may modify, add, remove, suspend, or discontinue any feature, functionality, data source, integration, research method, pricing structure, or portion of the Service.

Some changes may occur because public-record sources, third-party data providers, APIs, laws, regulations, or contractual requirements change.

We do not guarantee that any specific feature, dataset, source, or functionality will remain available indefinitely.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL INFORMATION, DATA, REPORTS, RESULTS, AND CONTENT PROVIDED THROUGH HEIR LENS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS.

HEIR LENS AND ITS LICENSORS AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, AND RESULTS.

HEIR LENS DOES NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
• ALL INFORMATION WILL BE CURRENT OR COMPLETE;
• EVERY OWNER, RELATIVE, HEIR, OR FAMILY MEMBER WILL BE FOUND;
• EVERY PERSON IDENTIFIED WILL ACTUALLY BE A LEGAL HEIR;
• EVERY PHONE NUMBER, ADDRESS, EMAIL, OR OTHER CONTACT RECORD WILL BE ACCURATE;
• EVERY VITALITY OR OCCUPANCY DETERMINATION WILL BE CORRECT;
• AN INHERITANCE CALCULATION WILL REFLECT ALL FACTS RELEVANT TO A PARTICULAR ESTATE;
• A PROPERTY WILL HAVE MARKETABLE OR CURABLE TITLE;
• A LEAD WILL RESULT IN A TRANSACTION, CONTACT, APPOINTMENT, CONTRACT, OR PROFIT; OR
• THE SERVICE WILL MEET YOUR PARTICULAR BUSINESS OBJECTIVES.

You assume responsibility for determining whether information obtained through Heir Lens is appropriate for your intended use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEIR LENS, ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, DATA PROVIDERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST BUSINESS OPPORTUNITIES, LOST DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE CLAIM IS BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANOTHER THEORY OF LIABILITY AND REGARDLESS OF WHETHER HEIR LENS WAS ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF HEIR LENS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO HEIR LENS DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Heir Lens LLC and its affiliates, members, managers, officers, employees, contractors, licensors, data providers, and service providers from and against claims, demands, actions, investigations, liabilities, losses, damages, penalties, judgments, settlements, costs, and reasonable attorneys’ fees arising out of or relating to:

• Your use or misuse of the Service;
• Your violation of these Terms;
• Your violation of applicable law;
• Your communications, advertising, solicitation, or marketing activities;
• Your use or disclosure of information obtained through Heir Lens;
• Your User Data;
• Your violation of another person’s privacy, publicity, intellectual-property, or other rights;
• Your unauthorized redistribution or resale of information; or
• Fraudulent, abusive, negligent, or unlawful conduct associated with your account.

Your use of Heir Lens does not create an attorney-client, fiduciary, partnership, joint-venture, employment, brokerage, agency, or other professional relationship between you and Heir Lens.

Heir Lens does not represent you in any real estate transaction, estate, probate proceeding, title matter, negotiation, or legal proceeding merely because you use the Service.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except to the extent federal law applies.

Subject to any rights that cannot lawfully be waived, any court proceeding arising out of or relating to these Terms or the Service shall be brought in a state or federal court having jurisdiction in Pennsylvania, and you consent to the personal jurisdiction of those courts.

We may update these Terms from time to time to reflect changes to the Service, law, regulatory requirements, data-provider requirements, security practices, or business operations.

When we make material changes, we will update the effective date and provide any additional notice required by applicable law.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision in the future.

You may not assign or transfer your rights or obligations under these Terms without prior written consent from Heir Lens.

Heir Lens may assign these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, change of control, or other business transaction, subject to applicable law.

These Terms, together with the Privacy Policy and any additional terms expressly presented to you in connection with a particular Heir Lens product or service, constitute the agreement between you and Heir Lens concerning your use of the Service and supersede prior agreements relating to that subject matter, except for a separately executed written agreement between you and Heir Lens that expressly states otherwise.
