Because Heir Lens is a real-estate research and data platform, the Service processes information both about:

1. Our customers and users, such as real-estate investors, agents, brokers, and other professionals who create accounts with Heir Lens; and
2. Individuals who are the subjects of research, such as property owners, former owners, deceased owners, relatives, potential heirs, family members, occupants, associates, and other individuals appearing in public records, licensed databases, user-submitted records, or other research sources.

The information we process depends on how the Service is used and which information is available from applicable sources.

When you create or use a Heir Lens account, we may collect information such as:

• Name;
• Business or company name;
• Email address;
• Telephone number;
• Mailing or billing address;
• Username and account credentials;
• Account preferences;
• Subscription or plan information;
• Transaction and purchase history;
• Credits, searches, pulls, or usage activity;
• Customer-support communications;
• Feedback and survey responses;
• Information you submit when contacting us;
• IP address;
• Device and browser information;
• Login information;
• Website and application activity;
• Cookies and similar technology identifiers; and
• Other information reasonably necessary to operate and secure your account.

Payment-card information may be processed by our third-party payment processor. Heir Lens does not necessarily receive or store complete payment-card numbers.

Users may provide information to Heir Lens in order to initiate property or individual research.

This may include:

• Property addresses;
• Property-owner names;
• Mailing addresses;
• Telephone numbers;
• Email addresses;
• Business names;
• Lead lists;
• CSV files;
• Spreadsheets;
• Notes;
• Family information;
• Known relatives;
• Known heirs;
• Probate or estate information;
• Property records; and
• Other information supplied as part of a research request.

Heir Lens may use these inputs to query public records, licensed databases, third-party services, or other sources and to generate research results.

Depending on the research being performed, Heir Lens may process personal information about individuals who do not themselves have a Heir Lens account.

That information may include, where available:

• Names and aliases;
• Current and previous addresses;
• Property addresses;
• Mailing addresses;
• Telephone numbers;
• Email addresses;
• Age or approximate age;
• Date of birth or birth-related information;
• Deceased or living-status indicators;
• Date or place of death;
• Obituary information;
• Property ownership;
• Parcel and assessment information;
• Real-estate records;
• Family relationships;
• Spouses;
• Parents;
• Children;
• Siblings;
• Grandchildren;
• Other relatives;
• Associates;
• Potential heirs;
• Occupancy indicators;
• Bankruptcy information;
• Liens;
• Judgments;
• Probate or estate-related information;
• Publicly available court or government records;
• Publicly available internet information;
• Historical addresses;
• Business affiliations; and
• Other information available through authorized public or licensed data sources.

Not every category is available for every individual or every search.

Some of this information is obtained from third-party licensed data providers. For example, one of Heir Lens’s licensed data services may return names, telephone numbers, addresses, email addresses, deceased indicators, relatives or associates, property information, age, bankruptcies, liens, and judgments when Heir Lens submits an authorized inquiry. Heir Lens’s provider agreement expressly limits the permitted uses of that information.

Heir Lens may obtain information from:

• Information provided directly by our users;
• Public property records;
• Tax-assessor records;
• Recorder or deed records;
• Probate and court records;
• Other government records;
• Publicly available websites;
• Obituaries and memorial information;
• Publicly available genealogical or historical information;
• Licensed data providers;
• Property-data providers;
• Contact-data providers;
• Skip-tracing and enrichment providers;
• APIs and technology providers;
• Other commercially available databases;
• Heir Lens’s own research and analysis; and
• Information inferred or generated through automated processing.

Information obtained from public records or third-party sources may be incomplete, outdated, inconsistent, or inaccurate.

We may use personal information to:

• Create and administer customer accounts;
• Authenticate users;
• Provide property and owner research;
• Process user-submitted searches;
• Match individuals and records;
• Identify possible family relationships;
• Construct family trees;
• Identify potential heirs or relatives;
• Determine or estimate living or deceased status;
• Provide contact-data or skip-tracing results;
• Identify possible property occupancy;
• Apply inheritance-law research rules;
• Generate reports and research summaries;
• Produce lead scores or prioritization;
• Process purchases and subscriptions;
• Track usage and credits;
• Provide technical and customer support;
• Improve the functionality and reliability of the Service;
• Detect fraud or misuse;
• Prevent unauthorized access;
• Protect the security of the Service;
• Enforce our Terms of Service;
• Comply with legal obligations;
• Respond to privacy-rights requests;
• Comply with contractual requirements imposed by licensed data providers; and
• Establish, exercise, or defend legal claims.

We may also use aggregated or de-identified information for analytics, service improvement, operational planning, and statistical purposes where permitted by law.

Heir Lens may use algorithms, automated systems, artificial intelligence, or similar technologies to help organize, compare, analyze, and summarize information.

For example, automated systems may assist with:

• Comparing names, addresses, dates, and records;
• Identifying potential record matches;
• Reviewing family relationships;
• Organizing family-tree information;
• Identifying possible heirs;
• Analyzing obituary or publicly available information;
• Applying inheritance-law research logic;
• Identifying potential occupancy;
• Summarizing research; and
• Generating lead scores or classifications.

Automated outputs are research tools and may contain errors.

Heir Lens does not intend its Service to be used to make decisions concerning an individual’s eligibility for employment, credit, insurance, housing, or other legally protected opportunities.

Certain licensed data used by Heir Lens is also subject to contractual AI restrictions. For example, one provider prohibits its licensed information from being used to train third-party AI models or for automated consequential decisions. Another provider permits third-party AI tools only for limited processing where the provider does not retain the licensed data for model training, development, or redistribution.

Accordingly, Heir Lens uses third-party AI and automated-processing services only in ways intended to comply with applicable contractual and legal restrictions.

Heir Lens licenses or accesses information from third-party data and technology providers.

These providers may receive information necessary to process a particular inquiry, such as:

• Name;
• Address;
• Email address;
• Telephone number;
• IP address;
• Business name; or
• Other search identifiers.

They may return matching information associated with the requested research.

Heir Lens does not grant users ownership of the underlying third-party databases.

Some licensed-data providers require Heir Lens to:

• Restrict how data is used;
• Prohibit resale or redistribution;
• Limit bulk delivery or extraction;
• Use information only for authorized real-estate-related purposes;
• Maintain data-security safeguards;
• Honor deletion or privacy requests;
• Restrict certain artificial-intelligence uses;
• Delete licensed information upon termination of the underlying provider relationship; or
• Suspend or limit access where misuse is suspected.

Heir Lens may therefore correct, suppress, restrict, delete, or make information unavailable when necessary to comply with law or contractual obligations.

A significant portion of the information processed by Heir Lens may originate from public records or publicly available sources.

Depending on the jurisdiction, some privacy laws treat publicly available or government-record information differently from other personal information.

However, Heir Lens may still apply reasonable privacy and data-use practices to such information.

The fact that information is publicly available does not mean that every use of that information is lawful. Heir Lens users remain responsible for using information obtained through the Service in accordance with applicable law and the Heir Lens Terms of Service.

Heir Lens may disclose personal information to the following categories of recipients where reasonably necessary:

Service Providers

• Cybersecurity;

• Authentication;

These providers may process information on our behalf as necessary to perform their services.

Licensed Data Providers

We may transmit search inputs to authorized third-party data providers to return information responsive to a user’s inquiry.

Heir Lens Customers

Research results may be displayed to the customer who requested the applicable research, subject to our Terms of Service and applicable provider restrictions.

Legal and Regulatory Disclosures

We may disclose information where we reasonably believe disclosure is required to:

• Comply with law;
• Respond to a subpoena, court order, warrant, or legal process;
• Respond to a government request;
• Protect the rights or safety of Heir Lens or another person;
• Investigate fraud or security threats;
• Enforce our Terms of Service; or
• Establish or defend legal claims.

Corporate Transactions

Information may be disclosed as part of a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar corporate transaction, subject to applicable law.

Privacy laws use terms such as “sell,” “sale,” “share,” “targeted advertising,” and similar concepts differently from ordinary everyday language.

Heir Lens may provide personal information obtained from authorized sources to paying business users as part of its real-estate research Service.

Depending on the applicable jurisdiction and the specific way Heir Lens operates, some such activity could potentially fall within a statutory definition of “sale” or “sharing” of personal information even where Heir Lens does not sell an individual’s information in the traditional sense.

Where applicable privacy law grants an individual the right to opt out of the sale, sharing, or targeted advertising involving their personal information, Heir Lens will honor valid requests as required by law.

Heir Lens does not knowingly sell or share personal information about individuals under 18 through the Service.

Heir Lens may use cookies and similar technologies to:

• Keep users signed in;
• Remember preferences;
• Maintain account security;
• Understand website usage;
• Diagnose errors;
• Measure performance;
• Improve features; and
• Understand how customers interact with the Service.

Some third-party service providers may also place or access cookies or similar identifiers.

Where required by applicable law, Heir Lens will provide appropriate choices regarding non-essential cookies or tracking technologies.

Heir Lens retains information for as long as reasonably necessary for the purposes for which it was collected, including to:

• Provide the Service;
• Maintain customer accounts;
• Preserve research projects;
• Process transactions;
• Maintain business and tax records;
• Prevent fraud;
• Resolve disputes;
• Enforce agreements;
• Meet legal requirements;
• Respond to privacy requests; and
• Comply with contractual requirements imposed by data providers.

Different categories of information may have different retention periods.

Licensed third-party information may be subject to shorter or provider-specific retention requirements.

For example, one of Heir Lens’s data-provider agreements requires Heir Lens to cooperate with requests to delete provider-derived personal information and to destroy the provider’s data upon termination or expiration of the agreement. Another provider restricts storage or caching beyond what is reasonably necessary to support permitted functionality and requires deletion of licensed data after termination of the provider relationship.

As a result, information previously available through Heir Lens may later be corrected, deleted, suppressed, or become unavailable.

Heir Lens uses commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

Measures may include, where appropriate:

• Access controls;
• Authentication;
• Encryption;
• Secure hosting infrastructure;
• Logging and monitoring;
• Restricted administrative access;
• Vendor-management procedures;
• Internal security controls; and
• Incident-response processes.

No information system can be guaranteed to be completely secure.

Users are responsible for protecting information that they export, download, copy, or otherwise maintain outside the Heir Lens platform.

If Heir Lens becomes aware of a security incident involving personal information, we will investigate and take appropriate steps in accordance with applicable law and our contractual obligations.

Certain data-provider agreements impose specific incident-response responsibilities on Heir Lens, including prompt investigation, mitigation, cooperation, and legally required notifications. One provider contract, for example, requires Heir Lens to notify that provider within 24 hours of a security incident involving its licensed information.

Where applicable law requires notification to affected individuals, regulators, or other parties, Heir Lens will provide such notification as required.

Depending on where you live and whether applicable law applies to Heir Lens, you may have rights relating to your personal information.

These rights may include the right to:

• Confirm whether we process your personal information;
• Request access to personal information;
• Request correction of inaccurate information;
• Request deletion of personal information;
• Obtain a copy of certain personal information;
• Opt out of certain sales of personal information;
• Opt out of certain sharing or targeted advertising;
• Opt out of certain profiling or automated processing;
• Limit certain uses of sensitive personal information;
• Appeal a decision concerning a privacy request; and
• Exercise privacy rights without unlawful discrimination.

These rights are subject to applicable exceptions and limitations.

For example, we may be legally permitted or required to retain certain information for fraud prevention, security, legal compliance, recordkeeping, contractual obligations, or other permitted purposes.

If you are a California resident and the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”), applies to Heir Lens or the applicable processing, you may have the right to:

• Know the categories and specific pieces of personal information we collect;
• Know the categories of sources from which personal information is collected;
• Know the business or commercial purposes for collecting, selling, or sharing personal information;
• Know the categories of third parties to whom information is disclosed;
• Request correction;
• Request deletion;
• Request access;
• Opt out of the sale or sharing of personal information;
• Limit certain uses or disclosures of sensitive personal information where applicable; and
• Not receive discriminatory treatment for exercising applicable privacy rights.

California law contains exemptions and exceptions, including for certain publicly available and government-record information.

California Notice at Collection

The categories of personal information we may collect are described throughout this Privacy Policy and may include:

• Identifiers;
• Contact information;
• Internet or electronic-network activity;
• Commercial information;
• Property information;
• Professional information;
• Geolocation-related information at a general address or property level;
• Inferences;
• Family and relationship information;
• Public-record information; and
• Other information submitted by users or obtained from authorized third-party sources.

We use these categories for the purposes described in Section 6.

California Data Broker Requests

If Heir Lens is required to register as a data broker or participate in a centralized California privacy-request system, Heir Lens will comply with applicable registration, deletion, opt-out, and reporting requirements.

California residents may also have the ability to submit deletion requests through a state-administered data-broker deletion mechanism where applicable.

Texas residents may have rights under the Texas Data Privacy and Security Act or other applicable Texas privacy laws.

These may include rights to:

• Confirm whether personal data is being processed;
• Access personal data;
• Correct inaccuracies;
• Delete personal data;
• Obtain portable copies of certain personal data;
• Opt out of certain sales;
• Opt out of targeted advertising; and
• Opt out of certain profiling.

Where required, Heir Lens will provide a mechanism to appeal the denial of a qualifying privacy request.

If Heir Lens is required to register as a data broker under Texas law, it will comply with applicable registration obligations.

Other states have enacted comprehensive consumer-privacy laws that may apply depending on Heir Lens’s activities, revenue, processing volume, business relationships, and the residency of the individual.

Where applicable, Heir Lens intends to honor legally required rights under state privacy laws, including rights relating to access, correction, deletion, portability, opt-out, and appeals.

This may include, where applicable, privacy laws in states such as:

• Colorado;
• Connecticut;
• Utah;
• Oregon;
• Montana;
• Delaware;
• Iowa;
• Indiana;

• New Jersey;

• and other states that enact applicable privacy legislation.

Because privacy laws continue to change, the exact rights available to you depend on the law in effect at the time of your request.

Your request should provide enough information for us to reasonably identify the person to whom the request relates and understand the request.

We may request additional information reasonably necessary to verify identity, prevent fraud, or determine whether a privacy law applies.

You may use an authorized agent where permitted by applicable law. We may require reasonable proof of that agent’s authority.

We will respond within the period required by applicable law.

Some information displayed through Heir Lens originates from licensed third-party data providers.

When we receive a privacy request involving information originating from one of those providers, we may:

• Process the request ourselves;
• Suppress or delete information from Heir Lens;
• Communicate the request to the applicable provider;
• Cooperate with the provider in processing the request; or
• Direct the requesting person to an appropriate provider mechanism where legally permitted.

One of our provider agreements expressly requires Heir Lens to cooperate with the provider in responding to consumer privacy requests, including providing or deleting provider-derived information where required.

Because Heir Lens processes information about individuals from public and third-party sources, people may sometimes believe that information associated with them is incorrect or outdated.

Heir Lens may provide a process for requesting:

• Correction of inaccurate information;
• Suppression of certain information;
• Removal of information;
• Updating a deceased or living-status indicator;
• Correction of contact information; or
• Review of an incorrect relationship or record match.

Submitting a request does not guarantee that all information will be changed or removed, particularly where Heir Lens is legally entitled or required to retain the information or where the information comes directly from a public record.

However, we may take reasonable steps to investigate substantiated reports of inaccurate information.

If Heir Lens becomes subject to a requirement to recognize browser-based universal opt-out signals, such as a legally recognized Global Privacy Control signal, Heir Lens will process such signals as required by applicable law.

Heir Lens is not designed to collect highly sensitive categories of personal information such as medical records, biometric templates, passwords to third-party accounts, or precise real-time GPS tracking information.

However, certain records or third-party sources may contain information that a particular state’s law defines as “sensitive data” or “sensitive personal information.”

Where applicable law imposes special requirements on such information, Heir Lens will process it in accordance with those requirements.

Users should not upload unnecessary sensitive information to the Service.

Heir Lens is intended for business and professional users and is not directed to children.

You must be at least 18 years old to create a Heir Lens account.

Heir Lens does not knowingly permit its Service to be used to target individuals under 18.

If we learn that we have collected personal information directly from a child in a manner prohibited by applicable law, we will take appropriate steps to delete it.

Heir Lens is not a consumer reporting agency, and the information provided through the Service is not intended to constitute a consumer report under the Fair Credit Reporting Act (“FCRA”).

Heir Lens may not be used to determine eligibility for:

• Credit;
• Employment;
• Insurance;
• Tenant screening;
• Housing eligibility; or
• Other purposes regulated by the FCRA.

One of Heir Lens’s licensed-data agreements expressly prohibits its information from being used for such FCRA purposes.

If you create an account or communicate with us, we may send transactional messages concerning:

• Your account;
• Purchases;
• Security;
• Product functionality;
• Customer support; and
• Service notices.

Where permitted, we may also send promotional or marketing communications regarding Heir Lens.

You may unsubscribe from marketing emails using the unsubscribe mechanism included in those communications.

You may still receive non-promotional communications necessary to administer your account or provide the Service.

Heir Lens customers may use research information for real-estate marketing and prospecting.

Heir Lens does not control the communications sent by customers after information is obtained from the Service.

Customers are responsible for complying with applicable marketing, solicitation, privacy, telemarketing, and communications laws, including, where applicable:

• Telephone Consumer Protection Act;
• National Do Not Call Registry requirements;
• CAN-SPAM Act;
• State telemarketing laws;
• State privacy laws; and
• Other applicable advertising and solicitation requirements.

Heir Lens’s data-provider agreements also expressly require compliance with applicable privacy, telephone, and email marketing laws.

Heir Lens is designed primarily for users and data relating to the United States.

Certain licensed data may be restricted to use or distribution within the United States.

If you access the Service from outside the United States, you are responsible for determining whether such access is permitted under applicable law and these Terms.

Heir Lens may restrict access to or disclosure of certain personal information where required by U.S. national-security, export-control, sanctions, or data-transfer laws.

Heir Lens does not knowingly provide restricted U.S. personal data to sanctioned persons or prohibited foreign recipients where doing so would violate applicable law.

Heir Lens obtains information from public records, third-party sources, licensed databases, and automated research.

We do not guarantee that personal information is accurate, complete, current, or free from error.

Addresses, phone numbers, property ownership, family relationships, deceased status, occupancy, and other records can change over time.

Users should independently verify important information before relying upon it.

We may update this Privacy Policy periodically to reflect:

• Changes to Heir Lens;
• New data sources;
• New features;
• Changes in law;
• New privacy requirements;
• New contractual requirements;
• Security practices; or
• Changes in how we process personal information.
